1.6 Our Platforms are directed to people residing in the United Kingdom. The information provided on the Platforms is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country.

1.7 Additional policies which also apply to your use of the Platforms include: our Privacy Policy and Cookie Policy. If you do not wish to be bound by the terms of the Privacy Policy and Cookie Policy, you should not use our Website or Web App.

1.8 If you decide to use one of our products or services (for example, applying for finance or insurance through a partner introduced via the Platforms) you will need to agree to the specific terms for these too (“Service Terms”). We will walk you through this at the time. These Terms of use will be deemed incorporated into those Service Terms. 4. Item data and assessment

4.1 Information regarding an item that is required for the operation of Spey Register's services — such as a description of the item, its name, provenance and estimated value according to the auction house, marketplace or dealer — must be provided when asked for while using the Platforms, or directly by Spey, to enable Spey to register, document and, where you choose, share the item with financial institutions, insurers or other authorised parties. You may also be asked to provide further information related to it such as images, proof of ownership or evidence of authenticity. Any information you provide for this purpose must be accurate and complete.

4.2 You must not register an item, or apply for Spey's services in relation to an item, where you have any knowledge or concern that the item may not be authentic, may be stolen, or may be subject to an undisclosed encumbrance.

4.3 You must have the right to share any material concerning the item that you provide to Spey.

4.4 Where your use of the Platforms relates to the consignment, financing or insurance of an item, you must be the lawful owner of that item or their duly authorised agent.

4.5 You acknowledge and agree that all assessments, valuations, scores and related information that may be generated by, or shared with you through, Spey Register are for informational purposes only and do not constitute financial, investment, or legal advice. Spey does not guarantee the accuracy, completeness, or reliability of any valuation and shall not be liable for any loss, damage, or financial detriment arising from reliance on its services. Users waive any claims, demands, or legal recourse against Spey related to discrepancies, market fluctuations, or subsequent sales based on the provided valuation.

4.6 By submitting data related to items such as descriptions, images, proof of ownership, or evidence of authenticity you grant Spey a non-exclusive, royalty-free, and perpetual right to use, analyse, store, and aggregate such information for the purpose of improving Spey's services.

4.7 Spey Register allows Users to record information about items, including alleged or actual encumbrances, and to make certain information publicly available. All entries are informational only, are the representation of the User who submitted them, and should be relied upon by Users and third parties at their own risk. Registration of an item or an encumbrance on Spey Register does not create legal title, perfect any security, act as any form of notice, or replace any statutory registration requirement.

5. Copyright

5.1 All content on the Website and Web App, including but not limited to text, images, graphics, and software, is protected by copyright laws and owned by or licensed to Spey.

5.2 You may not reproduce, distribute, modify, or otherwise use our content without prior written consent.

6.2 You are not permitted to use any of our trademarks without our approval.

7. Links to Third Parties

7.1 The Platforms may contain links to third-party websites for additional information or services. We do not endorse, control, or assume liability for the content or policies of these third-party websites. Users access these sites at their own risk.

7.2 These Terms only apply to the use of our services, and when you use third-party services their own terms will govern your use of those services.

8.1 We reserve the right, at our sole discretion, to:

  • Monitor the Platforms for compliance with these Terms.
  • Take legal action against any violations of laws or these Terms.
  • Restrict, suspend, or disable access to content if deemed necessary (e.g., for breaches of these Terms).
  • Remove or disable files that are excessively large or place an undue burden on our systems.
  • Manage the Platforms to protect our rights, property, and ensure proper functionality.

8.2 While we strive to maintain security, we do not guarantee that the Platforms will always be free from bugs or viruses.

8.3 You are responsible for securing your own devices, systems, and software when accessing the Platforms. You should use appropriate virus protection to safeguard against threats.

8.4 Although we make reasonable efforts to update the information on our Platforms, we make no representations, warranties or guarantees, whether express or implied, that the content on the Platforms is accurate, complete, or up to date.

8.5 We may modify, remove, or discontinue content or services on the Platforms at our sole discretion and without notice.

8.6 We do not guarantee uninterrupted access to the Platforms. Technical issues, maintenance, or unforeseen events may cause delays, restrictions, or downtime. We are not liable for any loss, damage, or inconvenience resulting from such interruptions.

8.7 The Platforms may contain errors, inaccuracies, or omissions related to services, pricing, or availability. We reserve the right to correct such errors and update information at any time without prior notice.

9. Disclaimer

9.1 The Platforms and Services are provided “as-is” and “as-available.” Your use of them is at your sole risk, except as expressly stated in these Terms. To the fullest extent permitted by law, we exclude all warranties, conditions, and representations, whether express or implied (including those arising by statute, custom, usage, or common law), relating to the Platforms and Services, including but not limited to implied warranties of satisfactory quality, fitness for a particular purpose, and non-infringement.

We are not responsible for delays or failures in performance due to circumstances beyond our reasonable control.

9.3 Our liability for any loss or damage is strictly limited as follows: We will not be responsible for direct, indirect, or consequential losses arising from the use or inability to use our Platforms, linked websites, or materials posted on them. This includes, but is not limited to, loss of income, business, profits, contracts, anticipated savings, data, goodwill, or wasted management time. However, we do not exclude liability where unlawful, including for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

9.4 To the maximum extent permitted by law, Spey is not liable for any loss or damage, whether direct, indirect, special, or consequential, including but not limited to loss of profits, goodwill, financial loss, data theft or corruption, device failure, or inability to use the Platforms. This applies even if Spey has been advised of the possibility of such damages, including those resulting from errors, omissions, performance failures, unauthorised access, delays, transmission failures, malware, or other harm.

10. Intellectual Property Rights

10.1 Subject to these Terms, we own all current and future intellectual property rights, including copyrights, trademarks (registered and unregistered), design rights, database rights, and any related rights on the Platforms, and all content published on them.

10.2 If any intellectual property rights automatically vest in you by law or otherwise, you agree to take all necessary steps, including signing relevant documents, to assign those rights back to us upon request.

10.3 You retain copyright ownership of any data you upload or submit to the Platforms. However, you grant us a worldwide, exclusive, royalty-free, non-revocable licence to use, copy, distribute, publish, and transmit such data as outlined in these Terms and our Privacy Policy.

11. General terms

11.1 By visiting the Platforms, sending emails, or completing online forms, you engage in electronic communications. You consent to receive electronic communications from us and agree that all agreements, notices, and disclosures provided via email or the Platforms satisfy any legal requirement for written communication. You also agree to the use of electronic signatures, agreements, and transaction records. You waive any legal requirements for original signatures, non-electronic records, or non-digital payments where permitted by law.

11.2 These Terms, along with any policies or rules posted on the Platforms, constitute the entire agreement governing your use of our Platforms and Services.

11.3 Our failure to enforce any right or provision does not waive our ability to enforce it later.

11.4 We may assign our rights and obligations to others at any time, and these Terms will remain binding on any assignee.

11.5 We are not liable for any loss, damage, delay, or failure to act due to circumstances beyond our reasonable control.

11.6 If any part of these Terms is found unlawful, void, or unenforceable, it shall be severed without affecting the validity of the remaining provisions.
